General Terms and Conditions

By using the services of Diamonds Deluxe Services, the client accepts the conditions outlined below.

Article 1 – Definitions

1. (Escort) Lady (Diamonds): The person engaged by Diamonds Deluxe Services, aged 21 or older, who performs a booking. This person is always represented by Diamonds Deluxe Services.
2. Client: Legal entities as well as natural persons aged 18 or older who wish to enter into a booking agreement with Diamonds Deluxe Services.
3. Parties: Diamonds Deluxe Services and the client together.
4. Diamonds Deluxe Services: Company registered in the Commercial Register under Diamonds Consultancy. Chamber of Commerce number: 93547307. VAT number: NL005026343B03.
5. Website: The website of Diamonds Deluxe Services, known as Diamonds Deluxe Services. www.diamondsdeluxeservices.com
6. Booking: An agreement for services and all related agreements between the client and Diamonds Deluxe Services, including the booking of a package.
7. Package: A service package based on the client’s wishes and in consultation with Diamonds Deluxe Services.
8. Payment: The transfer of money from the client to Diamonds Deluxe Services. Diamonds Deluxe Services uses the KNAB bank. Payments will be processed under the name Diamonds Consultancy and cannot be related to our services.
9. Booking Confirmation: A confirmation from Diamonds Deluxe Services to the client outlining the agreements between the parties regarding a booking.
10. Booking Request: Any request from a client to Diamonds Deluxe Services made via the website, email, phone, or any other communication method where the client intends to use the services of Diamonds Deluxe Services, as determined by Diamonds Deluxe Services.

Article 2 – Applicability

11. These general terms and conditions apply to all offers made by Diamonds Deluxe Services as well as all bookings and related legal relationships. Deviations from these terms are only valid if expressly approved by Diamonds Deluxe Services in writing.
12. Diamonds Deluxe Services is always entitled to amend the content of these terms unilaterally.
13. The applicability of any general terms and conditions used by the client is expressly excluded.
14. At the time a booking is made, the client is deemed to have agreed to the exclusive applicability of these general terms, unless the parties have expressly agreed otherwise in writing.
15. If one or more provisions in these general terms are invalid or voided, the remaining provisions remain fully applicable. Diamonds Deluxe Services and the client will consult to agree on new provisions to replace the invalid or voided ones, taking into account the original provision’s intent.
16. A client who has already made a booking with Diamonds Deluxe Services is deemed to implicitly agree to the applicability of these general terms for subsequent and/or additional bookings and/or services.

Article 3 – Company

Diamonds Deluxe Services is a fully legal high-class escort service operating under license number … The high-class Diamonds are carefully selected by Diamonds Deluxe Services and perform their work based on a booking and of their own free will. In accordance with Dutch law, all our high-class Diamonds are 21 years or older.

Article 4 – Formation of the Booking

17. All offers or proposals made by Diamonds Deluxe Services are non-binding, unless stated otherwise in the offer and its acceptance.
18. A booking is only formed when Diamonds Deluxe Services expressly accepts the booking request. In case of a binding offer, the booking is formed at the time of the client’s acceptance. The booking confirmation from Diamonds Deluxe Services is considered correct and complete.
19. The booking replaces and supersedes all previous proposals, correspondence, agreements, or other communications.
20. Diamonds Deluxe Services is always entitled to refuse a booking request without giving a reason.

Article 5 – Bookings

21. Diamonds Deluxe Services will make every effort to match the client and high-class Diamond as best as possible to provide the client with the best possible experience during the booking.
22. Diamonds Deluxe Services reserves the right to provide the high-class Diamond with security in any form.
23. Bookings have a minimum duration of two hours.
24. Bookings are only carried out in a hygienic space, a luxury residence/hotel suite/accommodation with at least a four-star hotel rating.
25. The client is obligated to maintain a high level of personal hygiene during the booking. This includes, but is not limited to, the obligation to use a condom of the My Size brand if sexual contact could potentially occur during the booking. Diamonds Deluxe Services does not offer sex, but intimacy may occur. The client is also prohibited from requesting that the high-class Diamond refrain from using a condom during sexual contact. Any sex toys that the high-class Diamond brings may only be used with the high-class Diamond’s consent. Sex toys brought by the client can only be used with the high-class Diamond’s agreement, and they must be new and sealed.
26. All bookings performed by high-class Diamonds of Diamonds Deluxe Services are completed under the Safe Sex policy as outlined on the Diamonds Deluxe Services website.
27. The client must ensure during the booking:

• That the high-class Diamond is reachable by Diamonds Deluxe Services during the start, end, and, if necessary, throughout the booking;
• Not to possess drugs in any form;
• Not to offer drugs in any form to the high-class Diamond, except alcoholic beverages. The client is also prohibited from attempting to get the high-class Diamond to accept or use the offered drugs.
• To treat the high-class Diamond with respect and honor her boundaries.

28. The client must treat the high-class Diamond with respect during the booking and in accordance with these terms, which apply to every booking (confirmation). The client is never allowed to force the high-class Diamond into actions that violate the booking or her will, or that are illegal in the country where the booking takes place.
29. The client must refrain from (attempting) to deceive, intimidate, or act in any way that endangers the safety of Diamonds Deluxe Services and/or the high-class Diamond.
30. The high-class Diamond is in possession of color spray and is authorized to use it during threatening situations. She also has an SOS button on her phone connected to the police and can use it in threatening situations.

If the client spends time with a high-class Diamond without Diamonds Deluxe Services’ involvement, the client is immediately liable for the full standard prices as listed on the website, plus a penalty equal to twice the amount owed.

Article 6 – Cancellation or Modification by Diamonds Deluxe Services

31. Diamonds Deluxe Services may cancel or modify a booking at any time if:

• A high-class Diamond cannot be at the requested location and/or time;
• The requested location cannot guarantee the identity, integrity, and/or safety of a high-class Diamond;
• The client does not meet the agreed conditions of the booking within the agreed time frames, or if there are reasonable grounds to believe the client will not meet the conditions.

32. In the case of a change or cancellation as outlined in Article 7.1, Diamonds Deluxe Services will contact the client as soon as possible.
33. If the booking can only take place under changed circumstances, the client may cancel the booking free of charge.
34. If the booking is cancelled, neither Diamonds Deluxe Services nor the high-class Diamond is liable for any direct or indirect damages or expenses of the client.

Article 7 – Cancellation or Modification by the Client

35. If the client wishes to change or cancel the booking, they must contact Diamonds Deluxe Services as soon as possible.
36. Diamonds Deluxe Services and the high-class Diamond only have an obligation of effort regarding all conditions of the booking. If the high-class Diamond does not meet one or more of the client’s expectations, the client has no right to cancel or modify the booking. The client is only entitled to change the booking if the unmet expectations concern the personality or appearance of the high-class Diamond, and the client informs Diamonds Deluxe Services of their dissatisfaction within 10 minutes of the booking’s start. In this case, Diamonds Deluxe Services will make every effort to propose a realistic solution and modify the booking accordingly.
37. If the modification requested by the client concerns the high-class Diamond, time, or location, Diamonds Deluxe Services only has the obligation to adjust the booking as best as possible, or offer an alternative. However, Diamonds Deluxe Services reserves the right to cancel the booking.
38. Changes regarding the service provision during the booking are only possible if the high-class Diamond expressly agrees. If these changes incur additional costs, they must be paid before the booking is carried out.
39. If the high-class Diamond arrives up to 30 minutes late at the agreed location due to transportation issues, the client has no right to cancel the booking. If the delay exceeds 30 minutes, the client may cancel the booking by phone free of charge, unless the booking was made less than four hours in advance.
40. The client is allowed to cancel the booking by email or phone free of charge at least 24 hours before the original departure time.
41. If cancellation occurs later than 24 hours before the booking, and not due to force majeure, the client is not entitled to a refund of their (pre)payment, as assessed by Diamonds Deluxe Services’ management.

Article 8 – Prices and Price Changes

42. All standard prices provided by Diamonds Deluxe Services can be viewed on the website. These prices are in Euros, including VAT and excluding any other government-imposed levies.
43. For package prices, the client must contact Diamonds Deluxe Services due to the package’s specific conditions. The website only displays “starting from” prices.
44. The price quoted by Diamonds Deluxe Services for the booking is solely for the service as specified in the agreement.
45. Discounts shown on the website are only applicable if agreed upon in advance with Diamonds Deluxe Services and confirm in the booking confirmation.
46. ​​Diamonds Deluxe Services is entitled to increase the price in the event of an increase in one or more cost price factors and/or other costs that are necessary and/or relevant for the execution of the booking.
47. Costs that Diamonds Deluxe Services or the High-Class Diamond must make or to meet the (additional) wishes of the client are for the account of the client.
48. Additional wishes of the client to the agreed booking in accordance with the booking confirmation that require Diamonds Deluxe Services to perform more work or incur more costs than it could reasonably have expected when entering into the booking, are grounds for increasing the agreed price.
49. Price changes based on Article 9.5 and 9.6 of the General Terms and Conditions do not give the client the right to cancel the booking in whole or in part.

Article 9 – Payments I

50. All payments must be made prior to the booking, or at the latest immediately upon commencement of the booking, unless otherwise agreed in writing between the parties.
51. In the event of a booking of a package, the client must immediately pay the entire cost of the package in question to Diamonds Deluxe Services after receipt of the Booking Confirmation, by means of a transfer to a bank account to be designated by Diamonds Deluxe Services.

53. If a booking is cancelled by Diamonds Deluxe Services because there are valid reasons that the client endangers the safety of Diamonds Deluxe Services or High-Class Diamonds engaged by them, or threatens to reveal the identity of one or more High-Class Diamonds, or will damage the image of Diamonds Deluxe Services, the client is not entitled to a refund and the client will be charged the full amount. 54. If an International booking or a Booking of a package is cancelled by the client, the Client must nevertheless pay the costs incurred by Diamonds Deluxe Services to Diamonds Deluxe Services to that extent. These costs are not eligible for reimbursement.
54. If the client does not use services for which fees have been paid on his own initiative during the execution of the booking, these fees are not eligible for reimbursement.
55. If the client is entitled to a refund of any amount paid in connection with a cancelled booking, this will take place within five days after the booking would originally have taken place on a bank account designated by the client.
56. If the client has not paid in advance and not immediately during the extension of the booking, the High-Class Diamond engaged by Diamonds Deluxe Services is entitled to terminate the booking or refuse it in advance at the request of Diamonds Deluxe Services. Furthermore, the client owes 50% of the total booking amount including travel expenses if the client does not meet his payment obligations as in article 10.1 and 10.2. 58. All suites as referred to in the Arrangement or otherwise booked suites by Diamonds Deluxe Services will be booked on a non-refund basis, unless otherwise requested by the client.

Article 10 – Payments II

59. If Diamonds Deluxe Services receives a Booking Request from a client for whom Diamonds Deluxe Services has not previously arranged a booking, Diamonds Deluxe Services is entitled to require this client to pay a deposit of 40% by bank, depending on the type of booking. The payment must come from the client’s own bank account, which means that the name of the account holder must correspond with the name of the client. For cash payments in euros we require a 50%deposit via bank transfer or Tikkie of the booking fee.
60. Furthermore, the client must ensure that Diamonds Deluxe Services can determine with certainty no later than 4 hours in advance that the client is actually present at the agreed location.
61. If the payment behaviour and/or the financial situation of a client in the opinion of Diamonds Deluxe Services gives reason to provide more security, Diamonds Deluxe Services is entitled to require the client to pay an additional advance by bank. If the client fails to provide the requested security, Diamonds Deluxe Services is entitled, without prejudice to its other rights, to immediately suspend the further execution of the booking and all that the client owes to Diamonds Deluxe Services is immediately due and payable.
62. If Diamonds Deluxe Services is proven right in legal proceedings, all costs incurred by Diamonds Deluxe Services in connection with these proceedings will be borne by the client.
63. In all cases, Diamonds Deluxe Services has, in addition to the rights mentioned in this article, any

Article 11 – Discretion

64. All information of a client that is in the possession of Diamonds Deluxe Services by virtue of its services, is treated discreetly and will only be used for the performance of its services and the optimization of its future services. Its services also include: identity checks, general research in public sources and verification of the information provided by the client with the parties involved for the purpose of the safety of one or more High-Class Diamonds engaged by Diamonds Deluxe Services. It is strictly forbidden to take photos, videos or other recordings in which the High-Class Diamond is recognizable.
65. Information of the client that is in the possession of Diamonds Deluxe Services will never be shared with third parties, unless a legal regulation obliges Diamonds Deluxe Services to do so. 66. If a client provides incorrect information regarding his person (identity), Diamonds Deluxe Services reserves the right to display the information in question on a so-called blacklist and to share it with the police and the judiciary, in order to prevent future false information regarding Bookings.
66. If a client contacts a High-Class Diamond directly in violation of these general terms and conditions, attempts to contact the High-Class Diamond directly, or exchanges any contact details with the High-Class Diamond, Diamonds Deluxe Services reserves the right to share information about the client with third parties within the industry organizations in order to warn them of such actions by the client.

Article 12 – Liability

68. Diamonds Deluxe Services is not liable for damages, unless there is intent or deliberate recklessness on the part of Diamonds Deluxe Services.

69. Defects of any nature, disappointing experiences of the client, information on the Website or deviations from information provided on the Website, do not entitle the Client to (damage) compensation and/or restitution.
70. Diamonds Deluxe Services is furthermore not liable for any damage resulting from any action in violation of article 5.5. Diamonds Deluxe Services is not liable for damage related to matters stated in article 5.5.
71. Any liability of Diamonds Deluxe Services is at all times limited to (any) direct damage. Diamonds Deluxe Services is never liable for indirect and/or consequential damage.
72. Any contractual or non-contractual liability of Diamonds Deluxe Services is furthermore limited to a maximum of 100% of the net amount of the work charged.
73. If Diamonds Deluxe Services is held liable by a third party for any damage for which it is not liable under the Booking (including these general terms and conditions), the client will fully indemnify it in this regard and reimburse Diamonds Deluxe Services for everything that must be paid to this third party as well as the costs incurred in this regard. Article 13 – Warranty

With due observance of the obligation of Diamonds Deluxe Services as stated in the General Terms and Conditions, Diamonds Deluxe Services does not provide any guarantee to the client regarding the experience of the client during the Booking. This is also in view of the very personal experience that the nature of the service entails. Intimacy can arise, it has not been described or stated that this is offered.

Article 14 – Intellectual property

It is expressly prohibited to reproduce, publish or exploit the marketing and/or sales materials and products designed by Diamonds Deluxe Services, including but not limited to the content of the Website as well as the working method and other intellectual products of Diamonds Deluxe Services, all in the broadest sense of the word, with or without the involvement of third parties, unless Diamonds Deluxe Services has given its express written permission to do so.

Article 15 – Applicable law

74. All Booking requests, Bookings, including these General Terms and Conditions, are exclusively governed by Dutch law.
75. Any disputes between Diamonds Deluxe Services and the client or third parties arising from a Booking Request, Booking, including these General Terms and Conditions, will be submitted to the competent court of the district of North Holland in the Netherlands.
